Legazpi City, [11.21.17] – The City Prosecutor’s Office of Legazpi has recommended that the information for frustrated murder filed against the Batangueño suspected assassin, Michael Malveda y Beltran be withdrawn and a murder charge be filed before the Legazpi City Regional Trial Court following the death of German Sayas Alemania.
In a document obtained today by The Phippine Examiner from Police Superintendent Nilo S. Berdin, Chief of Police of Legazpi City Police Station, Legazpi City Prosecutor Brian B. Baleda approved today the resolution with no bail recommended.
The complaint affidavit signed by the private complainant dated November 20, 2017 was filed by Liza R. Alvarez, common-law wife of the victim, German Sayas Alemania, following his death.
Alemania’s death at 10:20 o’ clock in the morning of November 20, 2017 was confirmed by Dr. Jose S. Daep, Jr, the attending physician of Albay Doctors Hospital in its issued document with Registry Number 2017, Page 61, Book 57.
Death Certificate issued said, the following cause of death was indicated to wit:
Immediate Case of Death: a. Multiple Organ Failure
Antecedent Cause: Sepsis
Underlying Cause: Gunshot Wounds; Arm Right Fracture Humerus; Gunshot Wounds Penetrating Abdomen Cavity Perforating Transecting Jejunum@ 5 pt. Ileum & Mesentry @ 2 pt.
Michael Malveda y Beltran was accused for Frustrated Murder dated November 16, 2017 through NPS Docket Number No. V-02-INQ-17K-00142 for shooting German Sayas Alemania and Ana Marie Querobin y Lagman infront of a local mall in Legazpi City last November 15, 2017.
Malveda survived during the shoot out with the police and is still recuperating at the Bicol Regional Training and Teaching Hospital will be arrested as soon as the court issued the warrant of arrest against him, Berdin assured this publication during the interview.
