The ruling of the Permanent Court of Arbitration in The Hague, Netherlands in favour of the Philippines vs. China in the West Philippines Sea (South China Sea) is a resounding victory for the Filipino people. The International tribunal’s 5-Judge panel unanimously rules that China has no legal basis for its historic claims to the so-called “nine dash line” which encircles about 90 percent of the South China Sea . The disputed territory is part of the 200 miles Exclusive Economic Zone (EEZ) in the South China Sea, that belongs to the Philippine territory as defined under the United Nations Convention on the Law of the Sea (UNCLOS) which includes the Mischief Reef, Second Thomas Shoal and Reed Bank. China and the Philippines are both signatories to the UNCLOS.
The International tribunal further ruled that that China violated the Philippine Sovereignty when it constructed installations and artificial islands at Mischief Reef without the authorization of the Philippines.
The International tribunal also found out that China had interfered with Philippine petroleum exploration at Reed Bank, and it tried to prohibit Philippine fishermen from operating within Manila’s exclusive economic zone at Mischief Reef and Second Thomas Shoal.
In its act of aggression against the Philippines, Imperialist China invoked its so-called historical rights on the disputed territories, deployed military forces, constructed military installations, bullied the Philippine Coast Guard, and harassed Filipino fishermen.
The Imperialist United States of America and the US-Aquino regime capitalized on the China’s imperialistic aggression in the West Philippine Sea to justify the forging of the Enhanced Defense Cooperation Agreement (EDCA) that compromised the Philippine Sovereignty.
BAYAN-Bicol denounced and opposed EDCA but supports the arbitration case in the The Hague, Netherlands. BAYAN believes that it is only the collective effort of the Filipino people that can be relied upon to protect and defend national sovereignty. It also believes that concerted efforts and cooperation of countries having claims on the Spratly Islands is the best option to settle the dispute and not the military interference of imperialist powers like the US and China.
The decision of the Permanent Court of Arbitration is binding to both the Philippines and China. But China arrogantly expressed that it will not honor the decision of the Arbitration Court. China’s reaction to the ruling is expected. No imperialist country will easily yield to a client-state like the Philippines.
We call on all patriotic Filipinos to stand our ground, defend our sovereignty and oppose aggression of Imperialist China.
